Facebook Promo March 2019 Terms and Conditions

  1. The promoter is Sanctuary Mountain Maungatautari (Promoter), 99 Tari Road, Pukeatua, New Zealand, phone 07 870 5180.
  2. The promotion is the Sanctuary Mountain Maungatautari “Win Sanctuary Explorer Passes” prize draw which is open to participants in the Sanctuary Mountain Maungatautari Facebook Promo (SMM Facebook Promo).
  3. The prize consists of two (2) adult Sanctuary Explorer passes and one (1) child Sanctuary Explorer Pass.
  4. Information on how to enter the SMM Facebook Promo form part of these terms and conditions.  Entry into SMM Facebook Promo is deemed acceptance of these terms and conditions.
  5. Entry is only open to residents of New Zealand.  Employees of the Promoter or related companies, the Promoter’s agencies associated with this competition, and their immediate families, are ineligible to enter.
  6. Entrants under the age of 18 require written consent from their parent or guardian.
  7. The SMM Facebook Promo is open to individual persons only.
  8. To enter, entrants must (a) 'Like' the Sanctuary Mountain Maungatautari official Facebook page and must (b) comment on the post their most favourite NZ wildlife species and why. One comment = one entry. A Facebook user may enter more than once by commenting multiple times.
  9. The SMM Facebook Promo opens at 1200 on 11/03/2019 and closes at 1200 on 31/03/2019 (SMM Facebook Promo Period).  Entries received outside the SMM Facebook Promo Period will not be entered into the prize draw.
  10. One (1) Winner will be drawn randomly via electronic raffle (Random.Org) on 01/04/2019 from the valid entries received during the SMM Facebook Promo Period.
  11. The Winner will be notified within 3 days of the prize draw by the Sanctuary Mountain Maungatautari official Facebook Page.  If the Winner is unable to acknowledge the prize, the Promoter reserves the right to redraw the prize.  No compensation will be payable for a person who wins but cannot be contacted or does not claim their prize.
  12. The Prize may not be redeemed for cash, may not be exchanged for any other vouchers, or may not be used for full or partial payment of any items sold at the Visitor Centre.
  13. The Promoter will provide the Winner with the electronic codes to the double passes via the Sanctuary Mountain Maungatautari official Facebook Page.
  14. Subject to any applicable law, if for whatever reason a prize is unavailable, the Promoter reserves the right to substitute it for a prize of equal or greater value.
  15. In the event of any dispute, the Promoter reserves the right to award a prize to the Facebook account holder subject to the Facebook account holder confirming acceptance of these terms and conditions.
  16. In the event that an entrant who is younger than 18 years of age wins a prize, the prize will be awarded to the winner’s parent or legal guardian.  It is a condition of entry that winners or, if the winner is under the age of 18 years, their parent or legal guardian, may be required to sign acceptance of these terms and conditions prior to claiming any prize.
  17. The Promoter’s decision on all matters relating to the SMM Facebook prize draw will be final and no communication will be entered into.
  18. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  19. Entrants agree that if they win a prize, the Promoter may use the winner’s name, likeness, image, or photo in any media for the purposes of promoting the Promoter’s services without any obligation by the Promoter to pay the winner any remuneration, compensation, or fee.
  20. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process.
  21. The Promoter accepts no responsibility for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, whether due to error, omission, alteration, tampering, deletion, theft or destruction or unauthorised access to, or alteration of, entries.
  22. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the SMM Facebook Promo, including, but not limited to, arising out of the use of a prize.
  23. The Promoter is not liable or responsible for arranging or paying for transportation or any and all associated costs to use the double passes such as, but not limited to, getting to and from the Visitor Centre.
  24. Nothing in these terms and conditions is intended to exclude, restrict or modify a consumer’s rights under the Consumer Guarantees Act 1993.  These terms and conditions must be read subject to those statutory provisions and will not affect any statutory rights that an entrant may have in relation to the return of a prize.
  25. The Promoter, in its sole discretion, reserves the right to cancel, suspend, terminate or modify the SMM Facebook Promo or any part of the SMM Facebook Promo if fraud, technical failures or any other factor beyond the Promoter’s reasonable control adversely affects the Promoter’s ability to conduct the SMM Facebook Promo or part of the SMM Facebook Promo as contemplated in these terms and conditions.
  26. The Promoter collects personal information in order to conduct the SMM Facebook Promo and may, for this purpose, use the information provided for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to the entrant.
